Please read these Terms carefully before using the SwapandConnect platform. These Terms constitute a legally binding agreement between you and SwapandConnect.
By accessing or using the SwapandConnect platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform. These Terms apply to all users, including creators, viewers, and anyone who registers an account.
Access to financial features may not be available to residents or nationals of jurisdictions where cryptocurrency transactions or related activities are prohibited or require regulatory licensing that SwapandConnect does not hold. It is your sole responsibility to determine whether your use of the Platform is lawful in your country. SwapandConnect reserves the right to restrict access to any user based on geographic location at any time without notice. Eligibility: You must be at least 18 years old to create an account or use the Platform. By using SwapandConnect you represent and warrant that you are 18 or older. We may terminate accounts we reasonably believe belong to users under 18.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. We reserve the right to suspend or terminate accounts that contain false information.
Access to financial features — including sending gifts and transferring funds — may require successful completion of our Know Your Customer (KYC) verification process. You agree to provide truthful and accurate identity documents. SwapandConnect uses a certified third-party KYC provider to process your documents. Providing fraudulent or misleading documentation is a serious violation and may result in permanent account termination and referral to law enforcement. KYC verification will be required for access to financial features and will be activated prior to presale launch. Users will be notified in advance of when verification becomes mandatory.
SAC is a BEP-20 utility token on BNB Smart Chain, available via presale and planned to trade publicly on PancakeSwap post-launch. Within the app, digital gifts are currently purchased using USDT; following the SAC public launch, gifts are intended to become purchasable with SAC. SAC is not a security, share, bond, or investment product. Holding or acquiring SAC does not entitle you to profits, dividends, revenue share, or any guaranteed return. SwapandConnect makes no guarantees regarding future market value, price appreciation, or continued utility. Open market prices may fluctuate significantly and may decrease. The Platform reserves the right to modify in-platform rates, limits, gift pricing, and policies at any time with reasonable notice.
By uploading content to the Platform, you grant SwapandConnect a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on the Platform. You retain ownership of your original content. You are solely responsible for ensuring your content does not infringe third-party intellectual property rights, contain illegal material, or violate these Terms.
You agree not to: upload content that is illegal, harmful, abusive, harassing, or sexually explicit involving minors; impersonate any person or entity; manipulate or artificially inflate engagement metrics; use the Platform for money laundering or any illegal financial activity; attempt to reverse-engineer, hack, or disrupt the Platform; create multiple accounts to circumvent bans or restrictions.
SwapandConnect reserves the right to remove any content that violates these Terms or that we deem harmful to the community, at our sole discretion and without prior notice. Repeated violations will result in permanent account suspension. You may report violating content using the in-app report feature.
All in-platform transactions are final and non-refundable unless required by applicable law. SwapandConnect acts as an intermediary for in-platform gifting transactions and is not responsible for losses arising from user error, incorrect wallet addresses, or blockchain network failures. We do not provide financial advice and nothing on the Platform constitutes an investment recommendation. RISK WARNING: Digital asset markets are highly volatile. SwapandConnect does not recommend or encourage the purchase of any digital asset as an investment. Any decision to acquire, transfer, or hold SAC is made entirely at your own risk and discretion. SwapandConnect accepts no liability for any financial losses arising from your use of the platform.
Streamers are solely responsible for the content they broadcast. SwapandConnect may terminate any live stream that violates these Terms without notice. Streamers agree not to broadcast illegal activity, adult content, or content that infringes third-party rights. SwapandConnect reserves the right to ban users from live features for violations.
All Platform software, design, trademarks, logos, and non-user content are the exclusive property of SwapandConnect. You may not copy, reproduce, distribute, or create derivative works from our proprietary content without prior written consent. Copyright Takedown Process: If you believe that content on SwapandConnect infringes your copyright, please submit a takedown request to team@swapandconnect.org with the following information: (1) a description of the copyrighted work you claim has been infringed; (2) the URL or location of the allegedly infringing content on the Platform; (3) your contact information including name, address, and email; (4) a statement that you have a good faith belief that the use is not authorized by the copyright owner; (5) a statement that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf. We will review all valid requests and remove infringing content promptly.
The Platform is provided "as is" without warranties of any kind. SwapandConnect does not guarantee uninterrupted service, data accuracy, or that the Platform will be free from bugs or security vulnerabilities. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. SwapandConnect is not a financial institution, broker, investment adviser, or licensed financial service provider. Nothing on this Platform should be construed as financial, investment, tax, or legal advice. You are solely responsible for conducting your own due diligence before making any financial decisions. SwapandConnect shall not be held liable for any direct or indirect losses — including but not limited to loss of funds, loss of profit, or loss of opportunity — arising from your use of SAC tokens or participation in any crypto-related activity on or off the Platform.
To the maximum extent permitted by law, SwapandConnect's total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to us in the three months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.
We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. Any unused in-app balances or unsent digital gifts at the time of termination for cause may be forfeited. This does not affect SAC or other assets held in your own external wallet, which remain under your control.
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
SwapandConnect reserves the right to update these Terms at any time. We will notify users of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
SwapandConnect shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, blockchain network outages, government actions, regulatory changes, cyberattacks, exchange delistings, or any other circumstances outside our reasonable control. In such events, our obligations will be suspended for the duration of the force majeure event.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect and shall not be affected by such invalidity or unenforceability.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SwapandConnect with respect to your use of the Platform and supersede all prior agreements, representations, and understandings. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
